What is Title IX?
Sexual harassment is conduct on the basis of sex which includes Quid Pro Quo or Title IX Sexual Harassment as defined on page 3 of the Title IX Policy.
What is considered sexual assault?
Any sexual act directed against another person, without the consent of the complainant, including instances where the complainant is incapable of giving consent. Sexual assault can occur between individuals of the same or different sexes and/or genders. Examples of sexual assault can be found on pages 3 & 4 of the Title IX Policy.
What is dating violence?
Violence committed by a person who is or has been in a social relationship of a romantic or intimate nature with the Complainant. More information can be found on page 4 of the Title IX Policy.
What is domestic violence?
A felony or misdemeanor crime of violence committed by a current or former partner. Additional information on domestic violence can be found on page 4 of the Title IX Policy.
What is stalking?
Stalking is defined in the Title IX Policy as engaging in a course of conduct directed at a specific person that would cause a reasonable person to:
Fear for the person's safety or the safety of others; or
Suffer substantial emotional distress

What is consent?
Consent is a voluntary, positive, and respectful agreement between two or more people that is clear and said out-loud.
- Consent can be taken back at any time.
- Not saying "No" is not the same as saying "Yes".
- Sex without consent is assault and is not okay.
- Consent cannot be given when under the influence of drugs or alcohol and therefore it is not consensual sex when one or both parties are under the influence of drugs or alcohol.
What if I or someone I know has experienced any of the following: assault, sexual violence, discrimination and/or harassment?
- Report It!
- WNMU encourages you to preserve evidence by saving text messages, instant messages, social networking pages, other communications, and keeping pictures, logs or other copies of documents, if you or your friend have any, that would be useful to police and WNMU investigations and hearings. In the case of sexual assault please save sheets, clothes, or any other evidence unwashed in a paper bag.
- If a victim reports an incident of sexual assault, domestic violence, dating violence or stalking to WNMU PD and the incident is beyond the jurisdiction of the campus, WNMU PD assists victims with notifying the local police department if the victim so desires.
- Although WNMU strongly encourages all members of its community to report violations of this policy to law enforcement, it is the victim's choice whether or not to make such a report and victims have the right to decline involvement with the police. The victim may also begin and/or terminate the process at ANY TIME.
What is discrimination?
Discrimination is unequal or harmful treatment of people on the basis of race/ethnicity, color, national origin, age, spousal affiliation, sex, sexual orientation, gender identity, medical condition, disability, religion, pregnancy, genetic information, or veteran status, and any other basis protected by applicable law.

What will happen after I report?
- Regardless of whether a person elects to pursue a criminal complaint, WNMU assists reporting parties of sexual assault, domestic violence, dating violence, and stalking and provides a written explanation of their rights and options.
- Further, WNMU complies with New Mexico law in recognizing orders of protection.
- Additionally, any person who obtains an order of protection from another state or any reciprocal state should provide a copy to the WNMU PD and Title IX Coordinator.
- A complainant may then meet with the Title IX Coordinator or designee to discuss supportive measures.
- Incidents that present an immediate threat to public safety must be reported to the Threat Assessment Team.
What if I have been sexually assaulted?
If you have been sexually assaulted,
- Call Silver Regional Sexual Assault Services hotline 1-866-750-6474, so that an advocate can set up a SANE exam and provide additional support.
- If you have additional injuries, go to the emergency room.
